Basic Terms and Conditions

​

below are some of the basic Terms and conditions that needs to be followed:

​

1. Scope of Services:

The scope of services will include the following

•Time for Sourcing: Resumes should be shared within the time limit conveyed by the SPOC.

•Communicating the job Profile to the candidate. The Freelancer will share the Company brief and job description as provided by the Consultant.

•Coordinating with both the candidate and the concerned representative of the Consultant for scheduling the interviews.

•Assist the consultant as may be requested to meet the end results.

 

 2. Professional Fee:

Based on the level of personnel provided by Freelancer for different categories of work/services required, the consultant shall fix the professional fees payable by the consultant to Freelancer on a case-to-case basis. The same shall be informed to Freelancer in advance through email.

3. Out of Pocket Expenses:

Expenses incurred by the Freelancer in arranging the candidates’ interviews, viz., STD/ISD/Fax/Courier etc. would be borne by the Freelancer.

4. Non-Solicitation of Employees:

During the term of this Agreement, Freelancer will not directly or indirectly, Solicit or approach any of Consultant’s employees or employees with any of his clients for which Freelancer has been sourcing profiles for placement in any other company, within India or abroad.

The Freelancer shall not disclose or part with any information received or provided by the Consultant to any third party without prior approval from the Consultant.

5. Correspondence with Candidates:

All correspondence with the candidates including interview, scheduling and intimation of the selection outcome will be the responsibility of the Freelancer.

6. Offer Letters to Candidates:  

Upon the selection decision, the Company will inform the candidates of the selection through the consultant. After the candidate accepts the Company’s offer, the Freelancer will be informed of the Gross Annual compensation offered to the candidate.

​

7. Replacement Period:

In the event of the candidate leaving the company or getting terminated by client within 1/3/6 months of joining (as applicable), the Freelancer would be providing his/her replacement within 1 month without any charges. Replacement period may vary subject to position and client, which shall be communicated to the Freelancer in writing.

8. Terms of payment: 

Freelancer shall raise the invoice after 45 days from the date of joining. After the invoice raised by the Freelancer is found to be in order, payment will be released after deduction of taxes as applicable by government from time to time.

​

9. Quality Standards:   

We require the Freelancer to understand the requirement in terms of the skill sets demanded by the company across various functions accurately and send only quality resumes which would match the company’s requirements. The resumes should go through a proper channel of scrutiny, where competent professionals do the screening of the candidates.

10. Confidentiality:

All position related information such as job description; compensation etc. from the Company will have to be treated with total confidentiality by the Freelancer

​

11. Validity of Terms:   

The agreement stands valid for a financial year. The Consultant may, at its sole discretion, extend the term of this agreement for the desired period and, terms and conditions as mutually agreed upon by the consultant and the Freelancer.

Either party may terminate this agreement at any time by giving prior notice of thirty days in writing to the other party, without assigning any reason

12. Other Scenarios:

i). There might be a case wherein a resume appears to be fresh on portal but has been marked as duplicate by the client. In such a case, no credit will be given to the Freelancer for the said resume.

​

ii). Since Freelancer has a binding agreement with Skywings Advisors Pvt. Ltd, therefore any candidate Sourced or placed by the Freelancer with the client shall have to mention Skywings Advisors as reference. On not doing so Freelancer will lose the credit and Skywings will not be liable for the payout to the Freelancer.

 

iii). If changes are made by the Freelancer in the Candidate’s basic details (like feeding a fake contact number/ email id in place of candidate’s original Contact details) to avoid duplicity on the Vendor portal/Client Portal, credit will not go to that Freelancer. And on repeating the same the contract should be revoked without notice.

​

iv). If a candidate referred by Freelancer has already been contacted by Skywings Advisors Private Limited prior to the Freelancer, Skywings Advisors will inform the Freelancer about the same within 48 business hours from the time Freelancer has referred the candidate.
